
Four Legality Protocols were signed at the Prefecture relating to separate lots concerning the modernization works of State Road 106.
The lots involved are:
1. S.S. 106 “Jonica” Section 2 – Cutro Catanzaro stretch – Lot 1 from Catanzaro (Km 0+000) to
Uria junction included (Km 7+500 approx.);
2. S.S. 106 “Jonica” Section 2 – Cutro Catanzaro stretch – Lot 2 from Uria junction excluded (Km
7+500 approx.) to Cropani junction included (Km 15+000 approx.);
3. SS. 106 “Jonica” Section 2 – Cutro Catanzaro stretch – Lot 3 from Cropani junction excluded (km
15+000 approx.) to Marcedusa junction included (Km 25+000 approx.);
4. SS 106 “Jonica” Section 2 – Cutro Catanzaro stretch – Lot 4 from Marcedusa junction excluded
(Km25+000 approx.) to Petilino junction included (Km 35+000 approx.).
Signing them, according to their territorial areas of competence, in addition to the Prefect of Catanzaro, Castrese De
Rosa, were the Prefect of Crotone, Franca Ferraro, limited to lot no. 4, the Extraordinary Commissioner for
the implementation of infrastructural interventions on SS 106 “Jonica”, Eng. Francesco Caporaso, the
designated Manager of Anas S.p.A., as well as representatives of the sector trade unions
Fillea CGIL, Filca CISL and Feneal UIL and the Director of the Territorial Labor Inspectorate of Catanzaro,
Annarita Carnuccio.
The aim of the Pacts is to ensure the overriding public interest in legality and transparency in
the execution of the works through the exercise of monitoring and supervisory powers conferred by law,
also for the purposes of prevention, control and combating attempts at mafia infiltration and verifying the
safety and regularity of the construction sites.
To guarantee higher levels of anti-mafia prevention in the execution of the works, the regime of
anti-mafia information is extended to all subjects belonging to the “business chain” and to all
contractual cases, regardless of the object, value, duration and any condition
and method of execution.
If elements emerge relating to attempts at mafia infiltration involving
subjects in the business chain, the Awarding Authority undertakes to exercise the right of termination or
to impose on its Contractor the exercise of this right.
The signed Pacts aim to achieve significant safety standards on construction sites as well as compliance
with the employment conditions of workers.
In this regard, as part of actions aimed at countering possible infiltrations of organized crime
in the cycle of execution of the works, the Parties have agreed to pay particular attention to the methods of hiring labor, the related obligations provided for by labor legislation and the sectoral National Collective Labor Agreement (CCNL), and for this purpose undertake to define recruitment procedures of maximum transparency.
To have a complete picture of the operators, an IT database is established in which
data relating to subjects involved in any capacity in the design and/or
execution of the works are collected.
The database guarantees:
- monitoring of procedural and managerial aspects related to the design and
execution of the interventions;
- connection with the Major Works Monitoring System (MGO), providing for the presence,
implementation and management, in the ways and times established, of all data provided for in resolution
Cipe 15/2015;
- verification of the safety conditions of the construction sites;
- verification of compliance with the rights of employed workers;
- monitoring of the workforce present on site, specifying for each unit the professional qualification;
- monitoring of the supply of labor, in any way organized and carried out.
Specific planning tasks are envisaged: among these, particular importance is given to the drafting of the
“Coordinated control plan for the site and sub-site” by the awarding entity.
Implementation and management are the responsibility of the contractor and the interference manager, who
carry them out under the supervision of the awarding entity and with control carried out by the police forces and
the Anti-Mafia Interforce Groups established at the Prefectures.
The adopted regime applies to all contractual cases regardless of the object, duration,
threshold value and any condition and method of execution, including those concerning:
a) the supply and transport of water (excluding municipal companies);
a) canteen, cleaning and accommodation services for staff;
b) the supply of labor, in any way organized and carried out.
Specific safeguards are introduced to prevent the risks of unlawful interference for corrupt purposes and
to counter attempts at mafia interference through the inclusion in the tender specifications of
contractual clauses that require the awarding entity, the contractor and the interference manager to
report to the Prefect and the competent Judicial Authority any fact indicating mafia interference
or attempted corruption. Express sanctions and penalties apply to fraudulent conduct aimed at
circumventing these obligations, with the provision of contractual termination measures in favor of those who report.
Monitoring tasks are entrusted to a panel set up at the Prefecture of Catanzaro which
meets periodically making use of the Anti-Mafia Interforce Group and the appointees of the Territorial Labor Inspectorate according to the topics addressed.
